Towards a Convention on the Prevention and Punishment of Crimes against Humanity

In a brief entitled “Towards a Convention on the Prevention and Punishment of Crimes against Humanity: recommendations to States on the prohibition of amnesties and other similar measures of impunity”, CEJIL and 23 partner organizations urge States to support the opening of negotiations for an international treaty on Crimes against Humanity and to ensure that a prospective Convention explicitly bans amnesties and other similar measures of impunity, which may exempt perpetrators or alleged perpetrators of crimes against humanity from any criminal proceedings or sanctions.

In 2019, the International Law Commission (ILC) adopted the Draft Articles on Prevention and Punishment of Crimes against Humanity (Draft Articles) and transmitted them to the UN General Assembly, recommending the elaboration of a convention on the basis of the ILC Draft Articles. The Sixth Committee of the General Assembly is set to take a decision on the ILC recommendation in autumn 2024.
