August 28, 2017 –<\/strong> The civil society organizations which join this statement condemn in the strongest possible terms the decision by the President of Guatemala, Jimmy Morales, to declare Ivan Velasquez \u201cpersona non grata\u201d and order his immediate expulsion from the country. Velasquez is the Commissioner of CICIG, the International Commission against Impunity in Guatemala.<\/span><\/span><\/p>\n

The measure announced by President Morales marks a significant break with the government\u2019s commitments to fight impunity, and represents a severe attack against the investigatory and prosecutorial authority of CICIG and, by extension, the Guatemalan Attorney General\u2019s Office (MP).<\/span><\/span><\/p>\n

This declaration against Velasquez was made less than two days after CICIG and the MP requested that Congress suspend certain presidential immunities so that Morales could be investigated for campaign finance crimes. Morales\u2019 decision therefore strongly suggests that he seeks to block the criminal investigation into his alleged activity, in addition to shielding members of illegal security forces and clandestine security structures that are currently under investigation by the MP with the support of CICIG.<\/span><\/span><\/p>\n

We join the dismay expressed throughout the international community given the lack of legal basis for Morales\u2019 declaration. We note that the Inter-American Commission on Human Rights has affirmed that “the declaration of persona non grata must be applied in an exceptional manner, and never used as a justification to summarily expel an individual for the work of defending human rights.\u201d<\/span><\/span><\/p>\n

In this context, the signing organizations welcome the declarations by Guatemala\u2019s Human Rights Ombudsman, Jordan Rodas, in defense of the democratic order; as well as the ruling by the country\u2019s Constitutional Court to provisionally suspend the effects of the President\u2019s decision. We also call upon the competent authorities to guarantee the security of the Justices who voted in favor of said ruling.<\/span><\/span><\/p>\n

Moreover, we exhort President Jimmy Morales to comply with the Constitutional Court\u2019s ruling and to respect the principle of the separation of powers. We also urge all government officials to respect and guarantee the rights of the Guatemalan people to free expression and peaceful protest. Finally, we call upon the international protection bodies to be vigilant in ensuring that the rule of law is respected and that human rights are guaranteed.<\/span><\/span><\/p>\n
