Although heterosexual couples had the right to enjoy intimate visits, Martha \u00c1lvarez and her then life partner were denied this right.<\/p>\n<p><span title=\"derecho.\n\n\">For two years, Martha fought for her right to have intimate encounters with her partner and went as far as filing a complaint with the Ombudsman. While this resulted in authorization for a visit from her partner, the warden at Pereira ignored this authorization and denied Martha\u00b4s permission to receive a visit from her girlfriend. The warden later justified her decision by arguing that this right did not apply to the homosexuals, as it presented a set of security, disciplinary and moral risks.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span title=\"derecho.\n\n\"><span title=\"A esta discriminaci\u00f3n le siguieron m\u00e1s de una docena de traslados -llev\u00e1ndola de centro penal a centro penal, desembocando en el fin de la relaci\u00f3n con su pareja- que, en ciertas ocasiones, resultaron en agresiones f\u00edsicas y verbales a Martha.\">These acts of discrimination were followed by more than a dozen transfers to multiple prisons throughout Colombia, and lead to the end of the relationship with her partner. All transfers were made without any objective or reasonable reason. In certain cases, Martha became the target of physical and verbal aggressions in the prisons she was sent to. <\/span><\/span><\/span><\/span><\/p>\n<p><span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span title=\"derecho.\n\n\"><span title=\"Todos los traslados se realizaron sin que se diera una sanci\u00f3n disciplinaria o calificaci\u00f3n negativa de la conducta de Martha \u00c1lvarez, o una raz\u00f3n objetiva o razonable sobre la necesidad de los traslados.\n\n\"><span title=\"A pesar de la decisi\u00f3n de la Suprema Corte de Colombia de octubre del 2001, que garantiz\u00f3 a otra reclusa el derecho a visitas conyugales con su compa\u00f1era, a Martha \u00c1lvarez continuaron neg\u00e1ndole que ella pudiera acceder a tenerlas.\">Despite the October 2001 decision by Colombia\u00b4s Supreme Court which guaranteed another inmate the right to conjugal visits with her partner, Martha \u00c1lvarez was continuously deprived that right for another eight years. Finally, on December 16, 2002, Martha received her first visit from her then partner. Unfortunately, her struggles over the past eight years and experiences dealing with discriminatory and homophobic treatment left Martha with an immense sense of frustration and loneliness which would go on to affect her current and future relationships .<\/span><\/span><\/span><\/span><\/span><\/p>\n<p class=\"rtejustify\">\n<span style=\"font-size:14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span title=\"derecho.\n\n\"><span title=\"Todos los traslados se realizaron sin que se diera una sanci\u00f3n disciplinaria o calificaci\u00f3n negativa de la conducta de Martha \u00c1lvarez, o una raz\u00f3n objetiva o razonable sobre la necesidad de los traslados.\n\n\"><span title=\"El caso fue presentado ante el Sistema Interamericano de Derechos Humanos por la Red Nacional de Mujeres, Colombia Diversa y el Centro por la Justicia y el Derecho Internacional.\">The case was presented before the Inter-American Human Rights System by the Red Nacional de Mujeres, Colombia Diversa and the Center for Justice and International Law. <\/span><span title=\"Se espera que, el 6 de diciembre del 2017, el Estado ratifique un Acuerdo de Cumplimiento de las recomendaciones hechas por la Comisi\u00f3n Interamericana de Derechos Humanos, para reparar \u00edntegramente a Martha \u00c1lvarez y presentar mayor informaci\u00f3n sobre los avances realizados en materia de la situaci\u00f3n carcelaria\">It is expected that, on December 6, 2017, the State will ratify a compliance agreement based on the recommendations made by the Inter-American Commission on Human Rights with the goal of fully repairing Martha \u00c1lvarez and presenting more detailed information on the progress made regarding the prison situation of LGBTI people.<\/span><\/span><\/span><\/span><\/span><\/p>\n","protected":false},"featured_media":561,"menu_order":0,"template":"tpls\/single-casos-tpl.php","format":"standard","meta":[],"categories":[],"class_list":["post-566","caso","type-caso","status-publish","format-standard","has-post-thumbnail","hentry"],"_links":{"self":[{"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/caso\/566","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/caso"}],"about":[{"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/types\/caso"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/media\/561"}],"wp:attachment":[{"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/media?parent=566"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/cejil.org\/en\/wp-json\/wp\/v2\/categories?post=566"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
